Dear mrs.
I perfectly understand wat you are saying but unfortunately the Club is unable to provide the members with transportation service at this moment. As I mentioned before, I can not tell if the situation will remain the same for next year.
About the All Inclusive, for next year the preferred rate for our members is 70.00 usd per person per night.
Thanks and Regards,
Alejandra I.
SVC
I guess they can just pick apart our contracts at will.

I am preparing my story and will send it soon. We need more replies and faster. How can we spread the word more effectively?

We, too, are preparing our story for inclusion here. We are a little reluctant to post our contract. Can someone give us some assurances that it will remain confidential.

This afternoon I sent my story to profeco. In February, 2002I bought a “founding members” contract that was specific to “3rd Floor Beachfront” Junior Suite. THe place is wonderful over my 4 or 5 visits but each time, the staff and information available has been more hazy. Originally Elba Machado was the primary contract contact and she has had 3 or 4 assistants who were as helpful as they could be. But the stories of hurricane delays, government permits, and mangrove protection all stopping the construction combined with a different management firm almost every time I visited confounds the situation.
Any advice you can give me would be helpful.

Hello everyone, I also have the same contract as Tim! purchased mine in 2004. Wanted to go back when the construction was completed but every time we called we had some excuse why it has not been completed. This year we decided to travel to what is now Dreams. My wife and two kids are planning to travel in September. I decided to check for some info due to the recent hurricane and to my surprise I ran into you website! and others talking about the same situation. To say the least I’m confused at this point and angry. I called the Dreams to check my reservation and they told me I have one, but it is for a regular deluxe room! not the 1BDR I have been paying for. I’m ready to play phone tag today! but I need help if anyone has any information, or can help me with my situation. This is our first family vacation and I do not want to spend it angry and arguing in Mexico! would I have problem getting my room? Who should I talk to? Any info. that can help me!

I want to thank everyone for their assistance in getting us to this point. It appears that we will be filing a large claim $500K with Profeco using a Mexican attorney. This should happen before year end. Please keep checking the site and giving us updates on your success or attempts to make reservations. Also, how you are being treated. Be sure to follow the instructions in the letter you received.
Sincerely
Admin

Another note;
When and if you do visit Dreams, keep a positive attitude. Don’t let your worries ruin your trip. The place really is paradise, and our real complaint is that they sold us the dream but make it difficult or impossible to use it. Treat the staff as friends, Alejandra as your best source of information and reservations and have a good time. Too many guests walk around the place crabbing about the room, their towels, the beach…you name it. Don’t be one of them. The place is fantastic, and after 10 visits, we still look forward to returning.

We visited the resort in 2004 and were shown a single-room unit with kitchenette as a model of what we would enjoy in the new building under construction. We bought a timeshare including 15 regular weeks, which according to the contract only required payment of the maintenance fee for us to use. The contract also included a one-week all-inclusive enrollment gift.
So far, the club did not authorize the all-inclusive enrollment gift, and neither honored our regular weeks without an upgrade with payment for all-inclusive. Also, we are entitled to use a hotel room without kitchenette. There have been were many excuses including the need to wait for the new building. More recently, Alejandra acknowledged that the original club offices closed and contract were not been honored.
Your deadline to receive documentation for PROFECO was Dec 15. Can we still pile up ours?

Tried to make a reservation in February 2007. Found that we were locked out of the website because we hadn’t paid our fee even after we had tried on numerous occasions since November 2006 to do so, but w/o response. Couldn’t figure out why they weren’t barraging us with requests for payments since they had our cc number, address, phone numbers and email. Finally called Condo Trust who took our information, we paid them via CC and then they forwarded to SVC. SVC apparently was now through working through another organization and did not recognize our fees paid with Condo Trust (that’s another whole item of frustration), but informed us to just call and they would take our reservations on the phone. Got pissed off, figured there was nothing I could do, so I dropped the Mexico plans and went to Fiji (great time there!) and didn’t worry about it until today when we went to the website that is now non-existent to retrieve the phone number for a vacation we are planning in May to celebrate our son’t college graduation. Boy, do I feel stupid! I agree with everyone about the staff at Dreams (Sunscape when we bought) and that is why I let myself get “talked into” joining. Unfortunately because I didn’t see this website existed until now, my husband and I haven’t thrown our hat into the ring to participate. Is there any hope? As stated by a previous “victim” I too am concerned about providing my contract number. I would appreciate a reply with any help you can give.
Thanks, Rebecca

Could someone please let us know what is happening? We bought into Sole Vacations three years ago and initially I could get on the site and then I could never get on the site.
I am assuming that all of you have had the same experience? We paid a lot of money to buy into something that sounds like it is now nothing.
What’s the scoop?

Hello:
I also have a timeshare at Sole Vacation Club and have never been able to get logged in to the website, which I now cannot locate.
Elba Alvarez or Machada was my former contact person and I have not had success in contacting her regarding status of the timeshare.
I will watch this site to check for updates.

HI,
Just found this site the other day.
We bought into the Sole Club in 2004 for a Junior Suite, which has never been built. We are tired of staying in a hotel room and having to pay dues for something less than we contracted for. We really enjoy staying at the hotel, beach, food, service is great, but would like to get this resolved. We should either get all our money back or the units constructed as we were shown and sold. We are heading down there in December of 08, we can bring back information to share in this site. We plan on having a good time never the less.
From Info at SVC November 17th 2008. I think that the hotel is going to be our only option. The whole place was closed in September for environmental issues and violation of building permits. On November 15th they reopened with fines and some demolition to be done (minor) Since the government claimed that they only had permits for 150 rooms, they were first told that they would have to tear down all but the 150. That would have been about 3/4ths of the whole place. That has been settled, but I doubt that any additional construction will be allowed….but you never know. When you get down there, how about sending back photos of the units that were started and stopped in 2005. I suspect that that whole lot will have to be cleaned up and put back in a natural state.

We want to join the cause. We bought a junior suite in 2004 and have yet to see one or anything even close. We took digital photos back in 04 of a “junior suite”,if anyone is interested. Out story is mostly the same as everyone on the site. I hope it’s not to late to join up. Who will contact us? We plan on sending our information to Profeco as well.
Someone please email us?
The hotel was closed at the end of September by the Mexican EPA, but reopened November 15th. The “action” is on hold due to the legal issues. I would like to have the photos of the junior suite, if you can email them to me. For reservations, try this:

My story is the same as all of yours.
I did send in my info about my contract but have never heard anything else to do . Is there anything else we can do?I haven’t paid my maintance fee’s for a couple of years now I think it is cheaper to stay at another resort.I would love to get even a portion of the money I spent back. What else can we do?
January 25th, 2010 at 11:36 pm
I also purchased a timeshare with Sole Vacation Club in Tulum back in 2004. I have been paying maintainance fees for a Hotel Studio that doesn’t exist. I just found out today the reason why the construction was not completed. I have told my husband several times that we need to sue and get our money back.
So what happened? with the group action.
February 1st, 2010 at 10:17 pm
After trying unsuccessfully to get ahold of anyone to pay my dues, I ran onto several sites stating the problems with Sole or whatever it is. We unfortunately have the same situation. Two years in a row we arrrived to find the place closed. Great start to a trip. We had even upgraded from a hotel room to a two bedroom because of the one beautiful model. Certainly feel like we have been taken for a ride. My question if anyone knows is–do we pay our dues and hope the resort has to refund any money or if you haven’t do they say you are no longer “owners” if you get to far behind? Good luck to us all!!!!
April 6th, 2010 at 11:30 pm
We visited and bought early, going thru at least 3 name changes. We also upgraded a couple of times. The last time was during construction of the now abandoned “Members” multi-bedroom building. The story we were told was the owner of the resort and the Sole’ owner had a falling out during the north construction. The last time we managed to make reservations,we ended up in a governors suite in the old lobby building, not the best maintained accomodations, but we still had a great time seeing old friends.
As Rosie asked in January. Is anything happening with the group action and if so, is it too late to be included?

I also purchased a timeshare with Sole Vacation Club at what is now called Sunscape Tulum. I have not paid my maintenance fees either and never hear from the company. Have been curious for some time about the resort since it has changed hands so many times. I feel as though I wasted good money.
June 29th, 2010 at 6:37 pm
We purchased our timeshare in about 2004. We have been to what was then Sunscape twice (the first time and then once as owners)–last year the rate for mainetnance went up, and then we recieved the letter. I am wondering whether this will be the beginning of a gouging of members for more maintenance $ in the next few years. Trying to decide (as we have been for the past few years) whether we should just sell the timeshare altogether, but have yet to find a reputable firm (do you have any suggestions?) or whether we should stick with it and just cough up the $$. Based on the notes from the meeting it sounds like that is what we have to do if we want to keep it, but I am wondering whether what we have is now essentially impossible to sell? Thanks for your efforts here!

Has anybody received a new contract? if so how did you get it? Ihave been sending e-mails to the suggested address with no reply’s. Does anyone know what is going on?
November 7th, 2011 at 9:29 pm
After years of trying off and on to find a contact person for my time share I finally got in touch with Ms. Izaguirre who just told me today that there are changes made to my contract with Sole Club. I purchased my time share in 2002 with 99 years or perpetual ownership. I purchased this share because I thought I can use it when I retire and deed it to my children and grand children. I never had the chance to use it. Every time I planned to go to Cancun and Tulum I had encountered problems with reservation, I contacted Resorts advantage who told me I need to pay maintenance fee before I can book, when I explained I will pay use fee so I can use my time share they told me to contact Sole. I had difficulty contacting representatives at Sole, then Sunscape and now Dreams. In short, I have been back to Cancun using other time shares that I owned and exchanged. I finally found Dreams on Facebook hence contact with Ms. Izaguirre. So now I’m faced with this problem. By reading some of the posts above, Did everyone pay the fees and signed a new contract? Does this mean I just lost my money and my dream on vacations in Mexico when I retire next year is gone?
What happens to the perpetual ownership?
I’m looking forward to some more posts regarding this problem. Thank you.
Nina
